How long will it take to resolve my claim?
When will I receive money for damages? If you’ve never been involved in a truck accident case before, you may be asking yourself these and other questions.
While each case is unique, the timeline below provides an idea of what to expect.
Day 1
- You meet with The Minnesota Truck Accident Law Firm for a free consultation. If our attorneys establish that you have a case, we’ll offer representation.
- If you agree to representation, our firm notifies the trucking company, trucking company’s insurer and the client’s insurer that we are handling your case.
- We send a letter to the trucking company and the company’s insurer requesting that they preserve any evidence from the accident.
- We send for the police report and any accident reconstruction documents.
- The firm hires a private investigator to collect witness statements and physical evidence. If necessary, we also hire an accident reconstructionist.
Day 7
- If you or a loved one is receiving medical treatment, The Minnesota Truck Accident Law Firm will ensure that the bills are handled properly. We’ll continue to manage billing issues on a monthly basis, until your case is completely resolved.
Within 6 to 18 months
- We order all of the victim’s medical records and bills, and prepare a demand for settlement to send to the truck’s insurance company. Depending on severity of injury, this information is also sent to the trucking company’s attorney. The company’s insurer has 30 days to respond.
Within 7 to 19 months
- Our firm either negotiates a settlement or files a lawsuit on your behalf. Approximately 98% of cases are settled at this point.
Within 1 to 2 years
- If your case isn’t settled out of court, it will be tried in front of a jury.
